Terms and Services of Designer Packages
By agreeing and submitting your participant registration, you (hereinafter referred to as “client”) agree to comply with the following terms and conditions. Violations of these terms and conditions can be cause for ejection from an event without a refund, and can result in expulsion from future events. Incomplete registrations will not be accepted.
All models must register with Peekapose Productions to participate in any Peekapose Productions produced shows. All model registrations must be done two weeks before the show date. The client must provide a list of names and emails to the assigned production staff to confirm set model registration at least three weeks before the show date. If the set model does not have a registration on file with Peekapose Productions he/she/it will not walk nor participate in any Peekapose Productions showcase not limited to Infinite Exposure Shows. Therefore Peekapose Productions will not be in any form held responsible nor any price reductions on any of “Designer package” will take place. If the client selects the “Designer Creative Vision” or “Exclusive” package, the client must deliver the mood board (Hair and Make-up) within four weeks before the show date via email. If the client selects the “Designer Creative Vision” or “Exclusive” or any “Designer” package the call time for arrival for models will be set by assigned production staff and it may differ from client’s call time. Peekapose Productions is not held in any form responsible nor any price reductions will reflect on any designer packages, if the client “selected models” does not arrive on time for hair and make-up or is absent from show date. If “selected model” does not arrive during scheduled call time, makeup nor hair if applicable will not be provided by the Production.
For packages that includes editorial photo shoots (separate from runway photos), you must use models that are modeling in any Peekapose Productions shows that Peekapose is producing, including but not limited to: Infinite Exposure Shows and NYFW Infinite Exposure, you have one year on the date of your signed contract from Peekapose Productions to schedule and complete the editorial photoshoot if applicable, if not it will be waived and no discount will reflect of your total package price Editorial Photoshoots from designer packages listed above can not take place the day of any Peekapose Productions fashion shows and must take place in New York City. Submission to publication is not guaranteed but Peekapose Productions will make every effort to get editorial photoshoots published if applicable. No discount will reflect on the total price if the client chooses not to receive items from any and all designer packages.
All deposits, payments and/or installations are final. No refund will be granted, no exceptions. The complete payment must be made 30 days prior to the show date that is reflected on the installation plans per each package. We have the right to refuse your showcase for any Peekapose Production produced shows if the full payment is not made prior to the show that is reflected on the installations plans.
If the designer / client is not ready to present their garments on the runway on the selected time determined by Peekapose Production or Infinite Exposure Staff and exceeds beyond five- minutes from which the last designer or host exited the runway Peekapose Production or Infinite Exposure Show selected staff has the right to cancel the designer / clients presentation and no refund of any kind will be granted. If a client delays the show beyond 5-minutes from which the last designer or host exited the runway then additional fees may apply and the client is responsible for paying the additional fees.
If Client is not present and /or at set time on the day of the Fashion show that will be determined by producer or set personnel then Client (designer) forfeits payments and the showcase of their line at any Peekapose productions produced fashion shows. ‘Children designers” must have designee assigned and/or assistant to help monitor children models and assist them in getting ready for showcase in any Peekapose Productions shows, if “children designer” selects a package that consist of 30 looks or more than the “children designer” must have two designee that may include themselves and one other on the day of any Peekapose Production show at the set-time designated by the production.
Photography and Videography Release: All participants, including but not limited to, booth staff, vendors, and occupants grant Infinite Exposure Shows and /or Peekapose Productions the right to take still or moving photographs, video, digital, audio, or other recordings (“Photographs”), and to reproduce, display, distribute, perform, digitize, transmit, broadcast and otherwise use those Photographs, in any and all media and manners now known or hereafter discovered throughout the world in perpetuity, in whole or in part, modified or altered, either by themselves, or in combination with other photographs or materials, The Photographs may be used by Infinite Exposure Shows and/or Peekapose Productions for any purposes whatsoever including without limitation, all promotional and advertising uses, on its web site, and for other purposes. Participant expressly agrees to inform its Participants that they are granting these rights in consideration of the opportunity to participate in the event. Participant hereby forever releases and discharges Host from any and all claims, actions and demands arising out of or in connection with the use of the Photographs, including, without limitation any and all claims for invasion of privacy, publicity rights, defamation, trademark rights, and all other rights. Participant waives all rights to royalties, license fees, or other compensation related to the use of the Photograph.
Participants / Clients understand and accept that the timeline of the Infinite Exposure Shows and/ or Peekapose Productions is determined by designee staff members.
Permits, Licenses and Taxes: All participants are responsible for obtaining and complying with all necessary licenses, permits, and tax regulations required by the City of New York, Any fines or penalties incurred from will be the responsibility of the Participant.
Acknowledgement of Health Risk: All participants agree and fully understand that the novel coronavirus SARS-CoV-2 and any resulting disease, together with any mutation, adaptation, or variation thereof, “COVID-19” is an extremely contagious disease that can lead to severe illness and death, and there is an inherent danger and risk of exposure to COVID-19 in any place where people are present. While precautions and protocols will be implemented from time to time by Infinite Exposure Shows and/or Peekapose Productions including, but not limited to, federal, state and local governmental agencies will not eliminate the risk of exposure to COVID-19, and/or any other contagious or infectious illness or disease. People of all ages and health conditions can be and have been adversely affected by COVID-19, especially people with underlying medical conditions. The risk of severe illness from the contraction of COVID-19 increases steadily with age, and contracting COVID-19 can result in the further transmission of COVID-19 to my spouse, family members, and other contacts; and exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition..
Limitation of Liability, Indemnity, and Release: Infinite Exposure Shows and /or Peekapose Productions nor any of its officers, agents, volunteers, employees, independent contractors, or other representatives shall be held liable for, and they are expressly released from, liability for any damage, loss, harm, or injury to the person or property of Participant or any of its officers, agents, volunteers, employees, independent contractors, or other representatives, resulting from theft, fire, water, accident, or any other cause.
Participant, Client shall indemnify, defend, and hold harmless Infinite Exposure Shows and/ or Peekapose Productions, and any of its officers, agents, volunteers, employees, independent contractors, or other representatives (i) from and against any and all claims arising from any acts, failures to act, or negligence of Participant or any of its officers, agents, volunteers, employees, independent contractors or other representatives, (ii) from and against any and all claims arising from breach of, or default in the performance of any obligation on Participant’s part to be performed under, these terms and conditions, and (iii) from and against all costs, attorney’s fees, expenses, and liabilities incurred in the defense of any such claim or any action.
Under no circumstances shall Infinite Exposure Shows and/or Peekapose Productions be liable for consequential, indirect, special, or punitive damages of any kind, whether foreseeable or unforeseeable, whether based upon lost goodwill, lost profits, loss of use of the booth, or otherwise, and whether arising out of breach of any express or implied warranty, breach of contract, negligence, misrepresentation, strict liability, or otherwise.
Infinite Exposure Shows and/or Peekapose Productions events are executed primarily by a professional volunteer workforce doing their best to serve guests, address concerns, and everyone has an enjoyable experience. Obnoxious or disrespectful conduct towards organizers will not be tolerated, and may result in removal from the event.
As a selected participant that participates in any Peekapose Productions produced shows– I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN THIS ACTIVITY OR EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I am physically fit, have sufficiently prepared or trained for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity or event. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity or event in which I may participate, and that it will govern my actions and responsibilities at said activity or event. In consideration of my application and permitting me to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: Peekapose Productions and/or their owners, producers, directors, staff, Event venue, Rental Studios used for fittings or rehearsals, officers, employees, volunteers, representatives, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers; (B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise. I acknowledge that Peekapose Productions–Mr. Juan Carlos Guevara and their directors, Event venue, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of Peekapose Productions– Mr. Juan Carlos Guevara, I acknowledge that this activity or event may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of the event, and lack of hydration. These risks are not only inherent to participants, but are also present for volunteers.
CODE OF CONDUCT
The Producers will make the final decision regarding any production or operation of the show. The Producers reserve the right to amend/modify/remove models or models line up of any designer at any time prior to or during the show. Anyone who verbally/physically abuse staff will result in the immediate dismissal of the show and escorted by security. Any physical /verbal altercation or abuse will result in the immediate dismissal of the parties involved regardless of any explanation or reasoning of the altercation. Parties will be dismissed from the event and escorted by security. Infinite Exposure Shows, Peekapose Productions, the show’s venue, sponsors or partners will not be responsible for the loss/damage of item or items left behind. We do ask all participants to keep valuables home. LEGAL NOTE: Venue security cameras within the venue will be used to identify then arrest and prosecute any model/individuals caught executing a theft/damage to venue and/or personal items and/or property – it will also result in the dismissal from the show event and escorted by security. Participants/ Models/ Designer/ Volunteers/ are not allowed any additional guest(s) backstage (including additional help, family, friends etc. unless pre-approved by the production staff 2 weeks before show date).
PARENT / GUARDIAN WAIVER FOR MINORS (Under 18 years old)
The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the activity or event, and has agreed individually and on behalf of the child or ward, to the terms of the accident waiver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such.
If the Designer’s participation fee is sponsored by a third party, which may include a client, another entity, or the production itself, the Designer remains **liable for the full cost of the designer package** for the season in the event of the following:
- The Designer does not attend the show.
- The Designer sends someone else to represent them but does not provide their own garments for the show.
- Designer does not show up
within the time frame determined by the production staff.
If the Designer does not fulfill their obligation to showcase their garments on the Infinite Exposure Shows platform or any Peekapose Production produced show, the Designer agrees to reimburse the Company for the full cost of the designer package.
Showcase Commitment
The Designer agrees to participate in a Peekapose Production LLC show including but not limited to Infinite Exposure Shows.
The Designer is required to showcase their own garments on the Infinite Exposure Shows platform.
Readiness and Presentation
The Designer agrees to be fully prepared for their scheduled presentation as determined by the production staff.
If the Designer is not ready at the time determined by the production staff, the Company reserves the right to:
- Cancel the Designer’s showcase without notice.
- Withhold any refunds or compensation related to the canceled showcase.
Non-Refundable Payments
All payments made by the Designer or on behalf of the Designer are non-refundable, regardless of circumstances, including the Designer’s failure to attend, lack of preparation, or failure to provide garments for the show.
Limitation of Liability
The Company, including its staff, contractors, and affiliates, will not be held liable for any loss, costs, or damages resulting from the Designer’s failure to attend, delays, or cancellation of the Designer’s showcase as outlined in this Agreement.
The Company reserves the right to *remove the client from the production* without notice if the client is:
- Disruptive to the production process.
- Disrespectful to staff, other models, designers, or participants.
- Creates any issues, problems, or disturbances that affect the event or production.
If the client is removed for any of the reasons stated above, no refunds will be granted and Designer agrees to reimburse the Company for the full cost of the designer package.
